These Terms and Conditions set out the rules for using BORNIAK websites, placing orders, entering into sales contracts, using a customer account, making payments, deliveries, returns, complaints, warranties, service support, promotions and the purchase of digital services, including the Borcook Plus subscription.

These Terms and Conditions apply to websites operated under the domains borniak.pl, borniak.de, borniak.com and borniak.co.uk, subject to separate provisions applicable to users and customers in the United Kingdom. For customers using borniak.co.uk, the UK-specific provisions set out below apply.

1. Definitions

For the purposes of these Terms and Conditions, the following terms have the meanings set out below:

  • BORNIAK – the trade brand used by ZUT BORNIAK Dawid Szurlej and BORNIAK LTD.
  • Seller – the entity indicated in section 2 of these Terms and Conditions, selling through the relevant Website.
  • Administrator – the entity operating the relevant Website or providing specific electronic services through the Website.
  • Websites – websites and online stores operated under the domains borniak.pl, borniak.de, borniak.com and borniak.co.uk, together with their functionalities.
  • Online Store – the part of the Website enabling Customers to place orders for Products, spare parts, services or subscriptions.
  • Marketplace – an external sales platform, in particular Allegro, Amazon or another platform used by the Seller to sell Products, spare parts, services or subscriptions.
  • Customer – a natural person, legal person or organisational unit placing an order or using BORNIAK services.
  • Consumer – a natural person entering into a contract for purposes not directly related to that person's business, trade or professional activity.
  • Business Customer – a natural person, legal person or organisational unit entering into a contract in connection with business, trade or professional activity.
  • Entrepreneur with consumer rights – a natural person entering into a contract directly related to that person's business activity where the contract is not of a professional nature for that person, if such rights are provided by the applicable law.
  • Product – a movable item offered in the Online Store, in particular smokehouses, smoke generators, accessories, spare parts, consumables or other goods under the BORNIAK brand.
  • Spare parts – elements, assemblies or components intended for repair, maintenance or use of BORNIAK products.
  • Digital service – an electronically supplied service, in particular the Borcook Plus subscription or another digital service offered by BORNIAK.
  • Borcook Plus – a paid subscription or digital service intended for use with the Borcook application or BORNIAK devices; its detailed functionality may be described in the Borcook application, on the website or in separate application terms.
  • Device – a BORNIAK product that may work with the Borcook application or digital services.
  • Device ID – a device identifier, serial number or other technical identifier allowing a subscription or digital service to be assigned to a specific device.
  • Customer Account – an individual account created in the Online Store, enabling the use of selected Website functions.
  • Order – a Customer's statement of intent aimed at entering into a contract for the sale of a Product, spare part, service or subscription.
  • Contract – a sales contract, contract for electronic services, contract for the supply of a digital service or another contract concluded between the Customer and the Seller.
  • Terms and Conditions – these BORNIAK Website and Online Store Terms and Conditions.

3. Scope of the Terms and Conditions

These Terms and Conditions set out in particular the rules for:

  • using the Websites,
  • using the Online Store,
  • creating and using the Customer Account,
  • placing Orders,
  • entering into Contracts,
  • selling Products and spare parts,
  • purchasing the Borcook Plus subscription,
  • making payments,
  • delivery and acceptance of Products,
  • withdrawal from the Contract,
  • complaints, warranty, service and repairs,
  • using promotions, discount codes and special campaigns,
  • communication concerning product safety,
  • liability of the Customer and the Seller.

These Terms and Conditions do not regulate in detail the use of the Borcook application, the account in the Borcook application or the functionality of the Borcook application. Rules for using the Borcook application may be set out in separate application terms.

These Terms and Conditions do not constitute an end-user licence agreement for firmware, device software or applications if such documents are adopted separately. Rules for using firmware and software may be set out in a separate EULA or other licence document.

4. Minimum age and legal capacity

The Websites, Online Store, Customer Account and paid services may be used by persons who are at least 18 years old or have full legal capacity.

Persons who do not have full legal capacity may use the Websites only with the consent and under the supervision of a legal representative, where permitted by applicable law and the nature of the service.

5. Types of electronic services

Through the Websites, the Seller may provide in particular the following electronic services:

  • allowing users to view Website content,
  • providing information about Products, prices, availability and distributors,
  • maintaining a Customer Account,
  • enabling Orders to be placed,
  • providing contact, service, complaint, warranty and return forms,
  • newsletter subscription,
  • purchase of the Borcook Plus subscription,
  • displaying customer reviews, trust marks and marketing information,
  • providing product documentation, manuals, safety warnings and technical information.

Electronic services consisting of viewing the Websites, maintaining the Customer Account, using forms and subscribing to the newsletter are generally free of charge, unless the description of a given service states otherwise.

6. Technical requirements and prohibited content

Use of the Websites requires:

  • a device with Internet access,
  • an up-to-date web browser,
  • an active Internet connection,
  • an active e-mail account if the user wants to create an account, place an order, receive notifications or use forms,
  • cookies and JavaScript enabled to the extent necessary for the proper operation of the Website.

The Seller does not guarantee correct operation of the Websites when non-standard, outdated or unsafe hardware, software or network configurations are used.

The user should use the Websites in accordance with the law, good practice, these Terms and Conditions, security rules and with respect for third-party rights.

It is prohibited to provide unlawful, misleading or third-party infringing content, viruses, malware or content that disrupts the operation of the Websites.

7. Customer Account

The user may create a Customer Account in the Online Store. The Customer Account allows, in particular, placing Orders, saving addresses, viewing purchase history and using other functions made available on the Website.

Creating a Customer Account is voluntary unless a particular Online Store function requires an account.

The user is obliged to provide true data and update them when they change.

The user is responsible for keeping Customer Account login details confidential and protecting them against unauthorised access.

If unauthorised access to the Customer Account is suspected, the user should immediately contact the Seller.

The user may delete the Customer Account independently if such function is available, or by contacting the Seller at support@borniak.com.

Deletion of the Customer Account does not delete data whose further storage is required by law, necessary to perform the Contract, handle complaints, warranty, tax and accounting obligations or establish or defend claims.

The Customer Account in the Online Store is not a Borcook application account and is not automatically linked to it.

8. Login through external providers

The Websites may allow login or registration through external identity providers, in particular Google Login and Apple Login.

If the user chooses login through an external provider, that provider may transfer to the Seller data necessary to create or maintain the Customer Account, such as first and last name, e-mail address or user identifier with the provider.

Using external login is voluntary. The user may also create a Customer Account using an e-mail address and password if such function is available.

9. Placing Orders

Orders may be placed through the Online Store and, if made available by the Seller, also by e-mail, contact form, telephone or other communication channels.

Information about Products, services, prices and availability published on the Websites does not constitute a binding offer within the meaning of civil law but an invitation to enter into a Contract, unless the content expressly states otherwise.

Placing an Order by the Customer constitutes an offer to enter into a Contract on the terms indicated in the Order and in these Terms and Conditions.

Placing an Order using a button or function marked in a way indicating an obligation to pay, in particular “order and pay”, “buy and pay” or equivalent, entails an obligation to pay.

To place an Order, the Customer must provide data required to fulfil that Order, in particular identification, contact, address, billing, payment and delivery data.

Orders may also be placed through external Marketplace platforms, in particular Allegro, Amazon or other platforms used by the Seller. In such case, the Customer may also be subject to the terms and rules of the given sales platform.

Orders placed through Marketplace may be automatically imported into the Seller's IT systems in order to fulfil the Order, handle payments, prepare shipment, issue sales documents, settle accounts, handle returns, complaints, warranty, service and after-sales support.

To ensure efficient Order fulfilment, data may be automatically transferred and synchronised between systems used by the Seller, in particular the e-commerce platform, ERP system, warehouse and logistics systems, accounting systems, payment systems and customer service systems, without the need for additional action by the Customer.

Before placing an Order, the Customer may check and correct the data entered in the order form.

After the Order is placed, the Seller may send the Customer confirmation of receipt of the Order or confirmation of acceptance of the Order for fulfilment to the e-mail address provided by the Customer.

The Contract is concluded upon confirmation of acceptance of the Order by the Seller, commencement of Order fulfilment, acceptance of payment or delivery of the Product, depending on the type of Order and the purchase process applicable on the relevant Website.

The Seller may refuse to fulfil an Order if the Product is unavailable, Customer data are incorrect, payment is not made, abuse is suspected, these Terms and Conditions are breached or for other justified reasons permitted by law.

10. Contract language

The Contract may be concluded in the language corresponding to the language version of the given Website, in particular:

  • borniak.pl – Polish,
  • borniak.de – German,
  • borniak.com – English or another language made available on the Website,
  • borniak.co.uk – English.

If several language versions of these Terms and Conditions or contractual documents are made available, the language version made available on the Website through which the Customer enters into the Contract is binding for that Customer, unless mandatory law provides otherwise.

11. Prices

Prices of Products, services and subscriptions are displayed in the Online Store. Prices may be shown in different currencies depending on the Website version, delivery country, sales market or Online Store settings.

Prices displayed to consumers are gross prices including the applicable VAT or other indirect tax, if applicable.

For Customers who are Business Customers, in particular with an active tax number, VAT number or other tax identification number, the way the price is displayed, VAT rate, reverse charge, zero rate or other tax rules may depend on the country of delivery, Customer tax status and applicable law.

Delivery costs, payment costs, additional services, customs duties, import taxes or other charges may be displayed separately if they depend on the country of delivery, payment method, delivery method or other circumstances.

The price valid at the time the Order is placed is binding for that Order, subject to obvious pricing, technical or system errors.

The Seller may change prices of Products, services and subscriptions. A price change does not affect Orders already accepted for fulfilment unless applicable law or the terms of a promotion provide otherwise.

Obvious pricing, technical or system errors, in particular a price significantly deviating from the actual value of the Product or resulting from a system error, do not constitute a binding commercial offer and may be corrected by the Seller.

12. Payments

Available payment methods are displayed in the Online Store during the Order process.

Depending on the country, currency, type of Order and technical availability, the following methods or providers may be available in particular:

  • traditional bank transfer,
  • Stripe,
  • card payment through Stripe,
  • Stripe Klarna,
  • Stripe BLIK,
  • Stripe Revolut,
  • PayPal,
  • PayU,
  • Klarna,
  • Apple Pay,
  • Google Pay,
  • other payment methods made available in the Online Store.

The list of payment providers may change. The current list of available payment methods is always displayed during the Order process.

The Seller does not store full payment card details. Card data, payment authentication data and other sensitive payment information are processed by external payment providers according to their terms and security rules.

The Customer is obliged to make payment within the deadline indicated in the Online Store, Order confirmation, invoice or other sales document.

If payment is not made within the required deadline, the Seller may cancel the Order or suspend its fulfilment, where permitted by law.

13. Retention of title

The Seller retains ownership of the Product until the Customer has paid the full price, provided that such retention of title is permitted by the applicable law.

For Business Customers, the Seller may apply extended retention of title to the extent permitted by the applicable law.

14. Delivery

Products are delivered to the address indicated by the Customer when placing the Order, subject to territorial, technical, logistics or legal restrictions.

Delivery costs are presented to the Customer before the Order is placed and may depend on the delivery country, parcel size, weight, selected delivery method, carrier and type of Product.

The Seller may offer free delivery of purchased Products or free delivery for Orders that meet the conditions specified in the Online Store, in particular regarding minimum Order value, delivery country, type of Product, delivery method, promotion period or selected sales channel.

The free delivery threshold, territorial scope, exclusions, available delivery methods and other free delivery conditions are always presented to the Customer in the Online Store before the Order is placed.

Free delivery may exclude oversized Products, pallet shipments, special deliveries, express deliveries, deliveries to hard-to-reach locations, islands, dependent territories or areas outside the standard delivery zone, unless information presented in the Online Store or the terms of a given promotion state otherwise.

The minimum Order value qualifying for free delivery may exclude delivery costs, digital services, subscriptions, gift cards, additional charges or other items indicated in the Online Store or the terms of a given promotion.

Depending on the country, type of Product and logistics availability, delivery may be carried out in particular by:

  • DHL,
  • DHL Freight,
  • DPD,
  • GLS,
  • UPS,
  • FedEx,
  • Raben,
  • Rhenus,
  • Schenker,
  • other carriers or logistics operators.

For oversized Products, in particular smokehouses or pallet shipments, delivery may be carried out by pallet or freight transport.

Unless information in the Online Store, Order confirmation or arrangements with the Customer state otherwise, pallet delivery may include delivery to the first accessible unloading point, driveway, ramp, property gate or kerbside closest to the delivery address.

The Customer is obliged to provide a correct and complete delivery address and contact details enabling delivery.

If delivery cannot be completed for reasons attributable to the Customer, in particular an incorrect address, failure to collect the parcel, inability to contact the Customer or refusal to accept the parcel, the Customer may be charged reasonable costs of redelivery, return or storage, where permitted by law.

15. Acceptance of the Product and transport damage

The Customer should check the condition of the parcel upon delivery, in particular whether the packaging is damaged, opened, wet, deformed or otherwise indicates possible damage to the Product.

If damage is found, the Customer should, where possible, prepare a damage report with the carrier, take photographs and promptly contact the Seller.

Failure to inspect the parcel upon receipt does not deprive the Consumer of statutory rights but may make it more difficult to pursue claims against the carrier or determine the circumstances of the damage.

Business Customers are obliged to inspect the parcel and Product within the time and scope required by the applicable commercial and transport laws.

The Customer should collect the parcel within the deadline and in accordance with the rules of the relevant carrier or logistics operator. If the parcel is not collected, incorrect address details are provided, the parcel is refused without legal basis or redelivery is necessary for reasons attributable to the Customer, the Seller may charge the Customer reasonable and documented costs of redelivery, return shipment, storage or other logistics costs, where permitted by law.

Provisions concerning failure to collect a parcel do not limit Consumer rights relating to withdrawal from the contract, lack of conformity of the Product with the Contract or other mandatory legal provisions.

16. Right of withdrawal from the Contract

A Consumer has the right to withdraw from a distance Contract within 14 days from the day on which the Consumer or a third party indicated by the Consumer, other than the carrier, takes possession of the Product.

If the Order includes several Products delivered separately, in batches or in parts, the withdrawal period may run from the day of taking possession of the last Product, batch or part, in accordance with the applicable law.

To exercise the right of withdrawal, the Consumer should inform the Seller of the decision by an unequivocal statement, for example through a return form, by e-mail or in writing.

The withdrawal statement may be sent to: support@borniak.com.

A model withdrawal form may be made available on the Website, in particular in the returns, withdrawal or customer help section. Using the form is not mandatory.

To meet the deadline, it is sufficient to send the withdrawal statement before the withdrawal period expires.

The right of withdrawal also applies to entrepreneurs with consumer rights where this follows from the applicable law.

17. Exclusions from the right of withdrawal

The right of withdrawal does not apply in cases provided for by applicable law, in particular in relation to:

  • non-prefabricated Products made to the Customer's specifications or clearly personalised,
  • Products liable to deteriorate or expire rapidly, if such Products are offered,
  • sealed Products which are not suitable for return due to health protection or hygiene reasons, if unsealed after delivery,
  • sealed audio or video recordings or computer software, if unsealed after delivery,
  • digital content or digital services where performance began with the Consumer's prior express consent and after the Consumer was informed of the loss of the right of withdrawal, where such exclusion is permitted by law,
  • other cases where applicable law excludes the right of withdrawal.

18. Effects of withdrawal

In the event of valid withdrawal, the Seller refunds to the Consumer the payments received, including the cost of the least expensive standard delivery offered by the Seller, in accordance with applicable law.

The refund is made using the same payment method used by the Consumer unless the Consumer expressly agrees to another refund method that does not involve any cost for the Consumer.

The Seller may withhold the refund until the returned Product is received or until the Consumer provides proof of having sent it back, whichever occurs first, unless the Seller offered to collect the Product.

The Consumer must send the Product back without undue delay and no later than 14 days from the day on which the Consumer informed the Seller of withdrawal, unless the Seller offered to collect the Product.

The Consumer bears the direct cost of returning the Product.

19. Return costs and return transport

The Consumer may arrange return transport independently or use return transport organised by the Seller if the Seller makes such option available.

If the Seller organises collection of the returned Product, the return transport cost may be deducted from the refund due to the Consumer, provided that the Consumer has been informed and has agreed to such settlement or where this follows from applicable law.

For Products shipped on pallets or requiring specialised transport, return costs may be significantly higher than standard courier shipment costs.

Estimated cost of collecting a returned Product:

  • parcel shipments: approximately 10–20 PLN or 5–10 EUR,
  • pallet shipments: approximately 250–400 PLN or 80–120 EUR.

The final cost depends on the country of collection, dimensions, weight, Product type, packaging and transport conditions.

The Customer should secure the returned Product appropriately for its type, size and weight, in particular in a way that reduces the risk of transport damage.

The Seller does not accept returns sent cash on delivery or parcels requiring the Seller to pay on receipt unless the parties expressly agree otherwise.

20. Reduction in Product value

The Consumer is liable for any reduction in the value of the Product resulting from handling it beyond what is necessary to establish the nature, characteristics and functioning of the Product.

To establish the nature, characteristics and functioning of the Product, the Consumer should handle and inspect the Product only as would be possible in a physical store.

If a reduction in value is found, the Seller may reduce the refund accordingly in accordance with applicable law.

Reduction in value may result in particular from damage, signs of use, soiling, missing accessories, removed markings, packaging damage beyond necessary inspection, use contrary to intended purpose or interference with the Product.

21. Product complaints

The Seller is liable to Consumers for conformity of the Product with the Contract under the applicable consumer protection laws.

The Consumer may submit a complaint due to lack of conformity with the Contract within the time limits provided by applicable law. In the case of consumer sales in Poland, the Seller is generally liable for lack of conformity found within 2 years from delivery of the Product to the Consumer unless the law provides a different period. For UK consumers, statutory rights under applicable UK consumer law remain unaffected.

If lack of conformity is found, the Customer may submit a complaint by contacting the Seller at support@borniak.com or using the complaint form if available on the Website.

The complaint form may be made available on the Website, in particular in the complaints, service, returns or customer help section. Using the form is not mandatory if applicable law allows a complaint to be submitted in another way.

The complaint should include data allowing identification of the Customer, Order, Product and a description of the reported lack of conformity or defect.

The Seller may ask the Customer to provide additional information, photos, videos, Product serial number, proof of purchase or other materials necessary to consider the complaint.

The Seller will respond to a Consumer complaint within 14 days of receipt unless applicable law provides another period.

These Terms and Conditions do not limit Consumers' rights arising from mandatory law.

22. Warranty

BORNIAK Products may be covered by a manufacturer's warranty for 24 months unless the warranty document, Product description, separate warranty terms or applicable law specify another period.

The warranty may cover selected Products, elements, parts or functionalities according to the warranty terms applicable to the given Product.

Detailed manufacturer warranty terms are set out in the warranty card, documents attached to the Product, Product documentation or on the BORNIAK website.

The warranty does not exclude, limit or suspend the Consumer's statutory rights arising from lack of conformity of the Product with the Contract.

Using the warranty may require presentation of proof of purchase, Product serial number, problem description and other information necessary to verify the claim.

If the Product was purchased from an authorised distributor, the Seller or manufacturer may request proof of purchase issued by that distributor, in particular a receipt, invoice, order confirmation or other proof of purchase.

23. Service, repairs and after-sales support

The Seller, manufacturer, authorised partner, distributor, service point or repair centre may provide service, diagnostic, warranty, post-warranty or repair services for BORNIAK Products.

As part of a service, complaint or warranty request, the Customer may be asked to provide:

  • problem description,
  • Product serial number,
  • Device ID or other technical identifier, if needed,
  • photos of the Product,
  • photos of damage,
  • video recordings,
  • proof of purchase, including proof of purchase from an authorised distributor,
  • PDF documents or other materials needed to assess the request.

Materials provided as part of a request are used to handle the request, diagnostics, repair, complaint, warranty, claims or legal obligations.

The Seller may transfer data and materials concerning the request to authorised partners, distributors, service points or repair centres to the extent necessary to handle the request.

24. Product safety and GPSR

BORNIAK Products should be used in accordance with their intended purpose, user manual, safety warnings, technical documentation and manufacturer's recommendations.

The Customer is obliged to read the user manual, safety warnings, Product markings and other information concerning safe use of the Product.

The manufacturer may publish product safety information, user manuals, warnings, service notices, security update information, service campaigns, corrective actions or product recalls.

Such information may be published in particular:

  • on BORNIAK websites,
  • in Product documentation,
  • in the Borcook application,
  • by e-mail,
  • through the Customer Account,
  • through authorised distributors, service partners or points of sale.

The Customer should follow safety notices, warnings, service recommendations and update information published by the manufacturer.

Product conformity documentation, including declarations of conformity, may be made available electronically on the Seller's or manufacturer's website or provided upon Customer request where required or appropriate for the Product.

25. Firmware, software and updates

Some BORNIAK Products may contain firmware, software, drivers, communication modules or other digital elements.

Firmware, software and updates may be installed only using methods, applications, tools or procedures provided or approved by the manufacturer.

The manufacturer is not responsible for the effects of installing software or firmware using unauthorised methods, tools, applications, files, modifications or procedures.

Software or firmware updates may add, remove or modify Product, application or digital service functions where justified by security, legal compliance, technical compatibility, improvement, bug fixing or product development.

The manufacturer does not guarantee that all digital functions will remain unchanged throughout the entire Product life, subject to Consumers' rights under applicable law.

BORNIAK devices retain their basic functionality consistent with their intended purpose regardless of the use of the Borcook application or Borcook Plus services, unless the description of a specific Product states otherwise. The application and digital services may constitute additional functionality extending the device's capabilities.

26. Borcook Plus – subscription purchase rules

The Online Store may allow the purchase of a Borcook Plus subscription intended for use in the Borcook application or with a compatible BORNIAK device.

These Terms and Conditions regulate only the purchase of the Borcook Plus subscription in the Online Store, in particular payment, billing period, automatic renewal, cancellation, assignment of the subscription to a device, complaints and promotions relating to the purchase of the subscription.

Detailed rules for using the Borcook application, application account, Borcook Plus functionality, limits, cloud services, publishing recipes and programmes and other application functions may be set out in separate Borcook application terms.

The Seller is not liable for lack of compatibility of the Borcook Plus subscription with non-BORNIAK devices, modified devices, devices with unauthorised firmware or devices used contrary to documentation.

The Borcook Plus subscription may be monthly, annual or offered for another billing period indicated during purchase.

The Borcook Plus subscription may renew automatically if this was indicated during purchase and the Customer gave the relevant consent or payment instruction.

The Customer may cancel the subscription at any time according to the functionalities of the Online Store, Borcook application, payment provider or by contacting the Seller. Cancellation does not necessarily result in a refund for an already started billing period unless applicable law, promotional terms or service terms provide otherwise.

If the laws of a particular country require a specific electronic subscription cancellation mechanism, the Seller or administrator of the relevant service will provide such mechanism in accordance with those laws. In particular, for consumers entering into subscription contracts through borniak.de, an electronic contract termination function compliant with German law may be made available.

After subscription cancellation, access to Borcook Plus functions may continue until the end of the paid billing period unless the terms of the given subscription provide otherwise.

The Borcook Plus subscription is assigned to a specific device indicated during purchase or connected to the user's account in the application. To purchase or activate the subscription, the Customer may be asked to provide the Device ID, serial number or other technical device identifier.

Changing the assignment of the subscription to another device may be restricted or require the consent of the Seller, Borcook application administrator or manufacturer, in particular to prevent abuse, circumvention of licence restrictions or unauthorised sharing of the subscription.

The current scope of functionality, limits, available plans, technical restrictions and requirements for Borcook Plus may be published in the Borcook application, on BORNIAK websites or in separate application terms.

The Seller or Borcook application administrator may develop, update, replace, withdraw or modify digital service functions provided this does not violate applicable law or users' acquired rights.

27. Withdrawal from contracts concerning digital services and subscriptions

When purchasing digital services, including Borcook Plus, the Consumer may have the right to withdraw from the Contract in accordance with applicable law.

The right of withdrawal from a Contract concerning a digital service or digital content may expire if performance began with the Consumer's prior express consent and after informing the Consumer of the loss of the right of withdrawal, where such exclusion is permitted by law.

If the law requires a specific notice, consent or confirmation of loss of the right of withdrawal, the Seller provides it to the Consumer during the purchase process or in another appropriate manner.

28. Promotions, discounts, discount codes and special campaigns

The Seller may organise promotions, marketing campaigns, loyalty programmes, discounts, coupons, discount codes, price promotions, free delivery, free trial periods, free periods of using digital services, Borcook Plus subscription promotions or other special campaigns.

Promotions may apply to selected Products, services, subscriptions, markets, countries, Customer groups, distributors, sales periods, device models or other criteria indicated by the Seller.

A monetary discount granted to the Customer constitutes only a reduction in the price of Products covered by the Order and cannot be exchanged for cash or paid out in any form.

If a monetary discount is used for an Order with a value lower than the discount granted, the unused part of the discount is forfeited unless the terms of the given promotion provide otherwise.

In the event of withdrawal from the Contract or return of a Product, only the amount actually paid by the Customer for the returned Product is refunded, taking into account the discount applied. The Customer has no claim for payment of the value of the used discount or its unused part.

Monetary discounts, discount codes, promotional funds and other forms of price reduction apply only to the value of Products in the basket and do not include delivery costs unless the terms of the given promotion expressly state otherwise.

Delivery cost is added to the Order according to the applicable price list and is settled separately unless the Order meets free delivery conditions or the terms of the given promotion state otherwise.

The Seller may grant free periods of using Borcook Plus, in particular for 1, 3, 6 or 12 months from the date of purchasing a device or as part of other promotional campaigns.

A free period of using Borcook Plus does not automatically convert into a paid subscription unless the Customer was clearly informed of this before starting the promotion and consented to automatic renewal or paid continuation of the service.

The Seller may organise temporary promotional campaigns including free access to selected digital services, premium functions or Borcook Plus for a specified period, including weekend free-subscription campaigns.

The scope of a promotion may vary depending on device model, market, country of purchase, distributor, purchase date, technical availability, sales channel or the terms of the given campaign.

Unless the terms of a given promotion provide otherwise, promotions, discounts, coupons, discount codes and free subscription periods cannot be combined.

The Seller may end, suspend or change promotion terms provided this does not violate acquired rights of participants or applicable law.

The Seller may organise promotions, competitions, marketing campaigns or loyalty programmes on the basis of separate terms, promotional communications, promotion descriptions, coupons, e-mails or information published on the Website.

Promotions may be limited in time, territory, quantity, product scope, to a particular Customer group, sales channel, selected distributors, selected devices or particular payment or delivery methods.

In the event of inconsistency between these Terms and Conditions and the terms of a particular promotion, the terms of that promotion apply provided they do not violate mandatory law.

29. Newsletter and marketing communication

The user may voluntarily subscribe to the BORNIAK newsletter.

Newsletter and marketing communication may include commercial information, information about Products, services, news, promotions, discount codes, special campaigns, free subscription periods, surveys, new Borcook Plus functions, updates, firmware, Product safety and other BORNIAK marketing activities.

Newsletter data may be collected through the Websites or Online Store and then exported or synchronised with Brevo, which is used to send newsletters, marketing communication, marketing automation, recipient segmentation and analysis of message effectiveness.

The user may unsubscribe from the newsletter at any time using the unsubscribe link in the message or by contacting the Seller.

Communication concerning Product safety, security updates, service actions or legal obligations may be sent independently of marketing consent where required or justified by applicable law.

30. Trusted Shops and customer reviews

The Websites may use Trusted Shops or other customer review systems to display trust marks, reviews, review invitations and possible buyer protection.

Transfer of data to Trusted Shops or another review system provider may include the e-mail address and Order data necessary to verify the transaction, send a review invitation, display reviews or use buyer protection.

The Customer undertakes that published reviews will be lawful, reliable, not misleading and will not infringe third-party rights.

31. User content

Some BORNIAK services or the Borcook application may allow users to create, save, publish or share content, in particular recipes, programmes, descriptions, photos, comments or other materials.

Detailed rules for using such functions may be set out in the Borcook application terms or in separate terms of the relevant service.

Upon publishing, sharing or submitting a recipe, programme, photo, description, comment or other content within BORNIAK or Borcook services, the user grants the Seller, manufacturer and entities operating within the BORNIAK brand a free, non-exclusive, transferable, sublicensable, worldwide and perpetual licence to use such content to the extent necessary to provide, develop, promote and maintain the services.

The licence includes in particular recording, reproducing, publishing, distributing, translating, modifying, adapting, creating derivative works, making publicly available, marketing use and use for providing and developing BORNIAK services.

The user represents that the user has all rights necessary to grant the above licence and that the content published or shared by the user does not infringe third-party rights, good practice or applicable law.

The Seller may remove, hide or restrict access to content violating these Terms and Conditions, the law, third-party rights, good practice, user safety or the interests of the BORNIAK brand.

32. Intellectual property

All content, trademarks, names, logos, photos, graphics, videos, descriptions, manuals, PDF documents, marketing materials, designs, software, firmware, page layout, databases and other materials available on the Websites are protected by intellectual property law unless stated otherwise.

Use of the Websites does not mean that the user acquires any intellectual property rights to BORNIAK content, Products, software, firmware, trademarks or materials.

Copying, distributing, modifying, making publicly available, commercially using or creating derivative works from BORNIAK content without the prior consent of the rights holder is prohibited unless mandatory law provides otherwise.

It is also prohibited to use bots, scrapers, crawlers, automated data collection tools, bulk copying, data mining, model training, content aggregation or other automated methods of obtaining data from the Websites without prior consent of the rights holder unless mandatory law provides otherwise.

Firmware may be installed only using official applications, tools or procedures provided or approved by the manufacturer.

33. Customer responsibility

The Customer is obliged to use Products, services, applications, firmware and documentation in accordance with their intended purpose, manuals, safety warnings, these Terms and Conditions and applicable law.

The Customer is responsible for the consequences of:

  • Product modifications,
  • interference with electronics, electrical installations, sensors, controllers or safety elements,
  • installation of unauthorised firmware or software,
  • use of non-original parts, accessories, electrical elements or components,
  • unauthorised repairs,
  • use of the Product contrary to the manual, warnings or intended purpose,
  • breach of safety rules,
  • providing incorrect data,
  • infringement of third-party rights.

The Seller and manufacturer are not liable for damage resulting from use of the Product contrary to the manual, warnings, safety rules, these Terms and Conditions or the Product's intended purpose.

Purchase of Products in the Online Store is intended for the Customer's normal consumer, professional or business use. Bulk purchase of Products for resale, wholesale distribution, marketplace sale or sale outside the authorised BORNIAK distribution network may require the Seller's prior consent if this follows from the nature of the Product, distribution policy, Product safety, applicable law or protection of the BORNIAK brand.

34. Limitation of liability for digital and cloud services

The Seller exercises due care to ensure the availability of digital services but does not guarantee uninterrupted or error-free availability unless mandatory law provides otherwise.

Digital services, cloud functions, online services, applications, servers, integrations, payment systems or communication systems may be temporarily unavailable due to maintenance, updates, failures, cyberattacks, infrastructure problems, telecommunications operators, Internet providers, cloud service providers, App Store, Google Play, payment operators or other third parties.

The Seller is not liable for unavailability of services resulting from failures of the user's Internet, user devices, telecommunications operators, app stores, operating systems, payment services or other third parties unless mandatory law provides otherwise.

The Seller may use technical and organisational measures to prevent abuse, circumvention of licence restrictions, unauthorised sharing of subscriptions or unauthorised access to digital services.

35. Compatibility, discontinued products and end of support

Not all functions of digital services, applications, firmware or Borcook Plus subscription need be available for all device models, hardware versions, software versions, countries or sales markets.

The scope of functions may depend on device model, hardware version, firmware version, application version, availability of cloud services, region, sales market, legal requirements or technical limitations.

The manufacturer may end development, sale, technical support or provision of services related to a specific Product, device, spare part, accessory, function, digital service or subscription, subject to applicable law.

The manufacturer does not guarantee unlimited availability over time of all Products, spare parts, accessories, consumables, digital services or software functions.

36. Provisions for Business Customers

For Customers who are Business Customers, to the extent permitted by applicable law:

  • the Seller may limit available payment, delivery or Order fulfilment methods,
  • the Seller may refuse to fulfil an Order where there is a justified economic risk, lack of Product availability or breach of these Terms and Conditions,
  • risk of accidental loss or damage to the Product may pass to the Business Customer upon release of the Product to the carrier, where permitted by applicable law,
  • the Business Customer is obliged to inspect the parcel and Product within the periods required by applicable law,
  • the Seller's liability may be limited to actual loss and the value of the relevant Order, excluding loss of profits, where permitted by applicable law.

In relation to Business Customers, warranty, liability for lack of conformity with the Contract or other statutory liability rules may be excluded or limited only to the extent permitted by applicable law.

Provisions relating to Business Customers do not limit rights of entrepreneurs with consumer rights to the extent resulting from applicable law.

37. Force majeure

The Seller is not liable for non-performance or delay in performance of obligations resulting from circumstances beyond the Seller's control that could not have been foreseen or prevented with due care.

Force majeure or circumstances beyond the Seller's control may include in particular natural disasters, fires, floods, epidemics, pandemics, wars, riots, terrorist acts, strikes, transport blockades, infrastructure failures, IT system failures, supplier failures, import or export restrictions, sanctions, decisions of public authorities and other extraordinary events.

If force majeure circumstances continue for a long time and prevent performance of the Contract, either party may withdraw from the Contract or terminate it in relation to the unperformed part, while preserving Consumers' rights under mandatory law.

38. Sanctions, export restrictions and legal compliance

BORNIAK Products, software, firmware, digital services and technologies may be subject to export restrictions, trade sanctions or other requirements under applicable law.

The Seller may refuse to fulfil an Order, delivery, service, update, support or transaction if fulfilment could violate sanctions, export restrictions, customs rules, safety rules or other applicable law.

The Customer undertakes not to use Products, software, firmware or digital services in a manner that violates law, sanctions, export restrictions or third-party rights.

39. Personal data

Rules for processing personal data of users and Customers are set out in the BORNIAK Privacy Policy available on the Websites.

Data provided when placing an Order, including through Marketplace, are processed in accordance with the BORNIAK Privacy Policy and may be used to the extent necessary for Order fulfilment, payment handling, delivery, issuing sales and accounting documents, settlements, returns, complaints, warranty, service and after-sales support.

For efficient sales handling, data may be automatically transferred and synchronised between sales, warehouse, logistics, accounting, ERP, payment and customer service systems used by the Seller, including between the e-commerce platform, ERP system, warehouse and logistics systems, accounting systems and customer service systems.

For Orders fulfilled by BORNIAK LTD, data necessary for accounting and tax support may be transferred to accounting systems and to providers of accounting and tax services.

40. Alternative dispute resolution

The Seller seeks to resolve disputes with Customers amicably.

A Consumer may use out-of-court complaint handling and claim resolution methods if available under the relevant law.

Information on available methods of alternative dispute resolution may be published by competent national authorities, consumer organisations or institutions responsible for consumer protection in the relevant country.

Use of alternative dispute resolution methods is voluntary unless mandatory law provides otherwise.

41. Governing law

Contracts concluded through borniak.pl, borniak.de and borniak.com are governed by Polish law, without excluding mandatory consumer protection provisions of the country where the Consumer has habitual residence.

The choice of Polish law does not deprive Consumers of protection granted to them by mandatory provisions of the country of their habitual residence, in particular where the Seller directs its activities to that country.

Contracts concluded through borniak.co.uk are subject to the United Kingdom provisions set out in section 42.

42. Provisions for users in the United Kingdom

For customers using borniak.co.uk, the Seller and service provider is BORNIAK LTD with the details indicated in section 2.3.

Contracts with BORNIAK LTD are governed by the laws of England and Wales, without prejudice to mandatory consumer rights under United Kingdom law.

These Terms and Conditions do not limit statutory rights of consumers in the United Kingdom, in particular rights under the Consumer Rights Act 2015, the Consumer Contracts Regulations and other mandatory consumer protection rules.

Where any provision of these Terms and Conditions conflicts with mandatory United Kingdom law, the mandatory law prevails.

43. Changes to the Terms and Conditions

The Seller may amend these Terms and Conditions, in particular in the event of:

  • changes in law,
  • changes to Website functionality,
  • introduction of new Products, services, digital services, payment methods or delivery methods,
  • organisational, technical, logistics or business process changes,
  • changes to contact details, business details or legal structure of the Seller,
  • the need to ensure security, prevent abuse or maintain legal compliance,

The current version of the Terms and Conditions is published on the Websites.

Changes to the Terms and Conditions do not affect Orders placed before the changes take effect unless applicable law or the nature of a continuous service provides otherwise.

For continuous electronic services or subscriptions, continuing to use the services after changes take effect may constitute acceptance of the new Terms and Conditions, provided that the user was properly informed of the changes and the right to terminate, and the applicable law permits this.

Changes materially affecting Consumer rights will be communicated in a manner compliant with legal requirements.

44. Final provisions

If any provision of these Terms and Conditions is found invalid or unenforceable, the remaining provisions remain in force.

Matters not regulated by these Terms and Conditions are governed by applicable law.

These Terms and Conditions apply in the version published on the relevant Website.

The Seller may transfer rights and obligations arising from these Terms and Conditions to a legal successor or an entity taking over the activity of the BORNIAK brand, in particular a capital company established to continue BORNIAK activity, while preserving Customers' rights under mandatory law.

The Controller may also offer additional digital services, licences, subscriptions or premium features connected with BORNIAK products in the future.

5. Sources of data

The Controller obtains personal data primarily directly from the user or customer, in particular when:

  • the user visits the Websites,
  • the user creates a customer account,
  • the customer places an order,
  • the customer places an order through an external sales platform, in particular Allegro, Amazon or another marketplace used by the Controller,
  • the user subscribes to the newsletter,
  • the user completes a contact, service, complaint, warranty or return form,
  • the user contacts the Controller by telephone, e-mail or otherwise,
  • the user consents to cookies or marketing and analytics technologies,
  • the user uses Google or Apple login.

The Controller may also receive data from payment partners, carriers, authorised service partners, distributors, marketplace platform operators, providers of sales, ERP, warehouse, logistics, accounting and customer service systems, analytics and marketing tools, customer review providers and entities maintaining technical infrastructure, to the extent necessary for the relevant purpose.

6. Purposes and legal bases of processing

The Controller processes personal data only where there is an appropriate legal basis. Data may be processed for the following purposes:

6.1. Use of the Websites and ensuring their security

Technical data, including IP address, browser data, session data and server logs, are processed to display the Websites correctly, ensure stability and security, and protect them against misuse, errors, attacks and unauthorised access.

Legal basis: Article 6(1)(f) GDPR – the Controller's legitimate interest in ensuring the security and proper operation of the Websites.

6.2. Creating and maintaining a customer account

Customer account data are processed to enable registration, login, account management, ordering, viewing order history and using customer account functions in the online store.

6.10. Customer reviews and trust marks

Data may be processed in connection with Trusted Shops and other review systems to send review invitations, display reviews, provide buyer protection or confirm store credibility.

6.13. Establishing and defending claims

7. Voluntary provision of data and consequences of failure to provide data

Providing personal data is voluntary, but in some cases it may be necessary to use specific Website functions, enter into or perform a contract, fulfil an order, process payment, delivery, complaint, warranty, return, service, repair, contact with the Controller or purchase of digital services.

Failure to provide data required for a given purpose may result in the inability to create a customer account, place an order, deliver an order, issue an invoice, process payment, consider a complaint, perform a service, respond to an enquiry or provide a digital service.

Providing data for newsletter, analytics cookies, marketing cookies, remarketing, ad personalisation or other consent-based activities is voluntary. Refusal of consent does not affect the use of basic Website functions but may limit certain additional functions, content personalisation or marketing communications.

8. Customer account in the online store

The user may create a customer account that allows, among other things, placing orders, saving addresses, viewing purchase history and using online store functions.

Creating an account is voluntary unless a particular function requires an account. The user may request account deletion at any time by contacting the Controller at support@borniak.com or using available account functions.

Account deletion does not delete data that the Controller must retain under applicable law, in particular data relating to orders, invoices, complaints, warranties, tax settlements or claims.

The online store customer account is not a Borcook mobile application account and is not automatically linked to it.

9. Google and Apple login

The Websites may allow login or registration through external identity providers, in particular Google Login and Apple Login.

If the user chooses Google or Apple login, the relevant provider may transfer to the Controller data necessary to create or maintain the account, such as name, e-mail address or user identifier with that provider. The scope of transferred data depends on the user's account settings and the rules of the provider.

Using external login is voluntary. The user may also create a store account using an e-mail address and password.

10. Orders, payments and invoices

To fulfil an order, the Controller processes data necessary to enter into and perform a sales contract or a contract for digital services, including identification, contact, address, billing, order and payment data.

The Controller does not store full payment card details. Card data, payment authentication data and other sensitive payment information are processed by external payment providers in accordance with their security rules and terms.

In connection with sales handling, Customer data may be automatically transferred, imported, exported or synchronised between systems used by the Controller, in particular the e-commerce platform, ERP system, warehouse and logistics systems, accounting systems, payment systems and customer service systems.

The automatic exchange of data takes place only to the extent necessary for order fulfilment, payment processing, delivery, issuing sales and accounting documents, settlements, handling returns, complaints, warranties, service, after-sales support and complying with the Controller's legal obligations.

For orders fulfilled by BORNIAK LTD in the United Kingdom, data necessary for settlements, issuing accounting documents, tax and accounting services may be transferred to accounting systems and to providers of accounting and tax services.

11. Borcook Plus digital subscription

The BORNIAK online store may allow the purchase of the Borcook Plus digital subscription. This subscription concerns digital services related to the Borcook ecosystem.

When purchasing a subscription, the user may be asked to provide a device identifier, serial number, licence identifier or other technical identifiers necessary to assign the service to a specific device. These data are processed only to fulfil the purchase, assign the right to use the service, handle the subscription, settlements, technical support and possible complaint handling.

The online store account and the Borcook application account are separate accounts. Detailed rules for using the Borcook application, including the application account, may be set out in separate terms and privacy policy available in the application.

If the subscription is renewable or recurring, data may be processed by the payment provider to handle recurring payments in accordance with the provider's rules and the user's consent or payment instruction.

The Controller may in the future offer additional digital services, licences, subscriptions, premium features or other solutions related to BORNIAK devices. In such case, data may be processed to the extent necessary to provide those services.

12. Contact, product, spare parts, complaint, return, warranty, service and repair forms

The Controller provides forms enabling contact, product enquiries, spare parts enquiries, complaints, returns, warranty claims, service or repair requests.

Forms may process identification data, contact data, order data, product data, device serial number, defect description, customer expectations and attachments.

Service and complaint forms may allow attachments to be uploaded, in particular:

  • photos of the device,
  • photos of damage,
  • invoices,
  • PDF documents,
  • other documents needed to handle the request.

The user should ensure that attachments do not contain personal data of third parties or special categories of personal data unless this is necessary to handle the request. In particular, the user should not send health data, political opinions, religion, biometric data, private life data or other sensitive data unless absolutely necessary due to the nature of the request.

13. Transfer of data to authorised partners, distributors and service points

For warranty, complaint, service, repair, diagnostic or after-sales activities, the Controller may transfer customer personal data to selected authorised partners, distributors, service points or repair centres cooperating with the BORNIAK brand.

The scope of transferred data is limited to information necessary to handle the request, in particular:

  • first and last name,
  • company name, if applicable,
  • e-mail address,
  • telephone number,
  • delivery, collection or service address,
  • order number,
  • device serial number,
  • data relating to the service, complaint or warranty request,
  • attached documents and diagnostic materials.

Authorised partners, distributors and service points process data only to the extent necessary to perform the assigned activities and in accordance with applicable data protection laws. Depending on the circumstances, they may act as processors on behalf of the Controller or as separate controllers if they independently decide on the purposes and means of processing under their own legal or organisational obligations.

14. Newsletter, marketing communication and marketing automation

The user may voluntarily subscribe to the BORNIAK newsletter. At least the e-mail address is processed for this purpose and, depending on the form, also name, language preference, country, marketing consents and technical confirmation of subscription.

Newsletter data may be collected in the online store and then exported or synchronised with Brevo, which is used to send newsletters, marketing communications, marketing automation, recipient segmentation and analysis of message effectiveness.

The Controller may also use Brevo for e-mail remarketing, in particular reminder messages, abandoned cart messages, product recommendations, information about promotions, discount codes, special campaigns or communications adapted to the user's previous interactions with the Websites, where the user has given appropriate consent or where another legal basis allows such activity.

The newsletter is sent until the user withdraws consent. The user may unsubscribe at any time using the unsubscribe link in the message or by contacting the Controller at support@borniak.com.

Some products, particularly smokers and large equipment, may be delivered on pallets or as oversized shipments.

Unless otherwise stated, delivery is made to the kerbside or another location accessible to the carrier's vehicle. Carry-in services are not included in standard delivery.

The estimated processing and delivery time is displayed on the product page, in the shopping cart or during checkout.

Products in stock are normally dispatched within 1–3 business days following payment confirmation or order acceptance.

Estimated delivery times from the date of dispatch are:

  • standard parcel deliveries: 2–5 business days,
  • pallet and oversized deliveries: 2–7 business days.

These delivery times are estimates only and may vary due to product availability, seasonal demand, weather conditions or circumstances beyond the carrier's control.

If transport damage is identified, the Customer should report it as soon as possible and, where possible, obtain a damage report from the carrier. Claims can be submitted using the online service or complaints form.

After selecting this payment method, Customers will be redirected to the payment provider's secure platform to complete the transaction.

Order Cancellation

An order may be cancelled until order processing has begun, in particular before the goods havebeen prepared for shipment, released to the warehouse, packed or handed over to the carrier.

To cancel an order, please contact our customer support team as soon as possible or use the onlineform.

If the order has not yet entered the fulfilment process, it will be cancelled and any payment receivedwill be refunded using the same payment method originally used, unless otherwise agreed.

Orders for customised, personalised or made-to-order products may not be cancelled onceproduction or fulfilment has commenced.

Right of Withdrawal

Consumers have the right to withdraw from a distance contract without giving any reason within 14days of receiving the goods.

To exercise the right of withdrawal, a clear statement of withdrawal must be submitted before theexpiry of the withdrawal period. This may be done using the online form, by email or by contactingcustomer support.

After submitting a withdrawal request, the goods must be returned without undue delay and nolater than 14 days from the date on which the withdrawal was communicated.

The consumer bears the direct cost of returning the goods. For oversized products, pallet shipmentsor products that cannot be returned using a standard courier service, return costs may be higher andwill depend on the size, weight, destination country and current carrier rates.

In the event of a valid withdrawal, we will reimburse all payments received, including the cost of theleast expensive standard delivery option offered, within 14 days of receiving the withdrawal notice. Wemay withhold reimbursement until we have received the returned goods or proof that the goods havebeen returned, whichever occurs first.

The consumer is responsible for any diminished value of the goods resulting from handling beyondwhat is necessary to establish the nature, characteristics and functioning of the goods.

Products purchased from a distributor

If the product was purchased from an authorised BORNIAK distributor or reseller, please attachproof of purchase. Depending on the nature of the case, the request may be handled directly byBORNIAK or referred to the appropriate service partner.

Shipping damage

We recommend checking the condition of the package and the product immediately upondelivery.

If the packaging appears damaged, opened, torn or crushed, or if the contents may have beendamaged during transport, please report the issue as soon as possible using the online form.

Where possible, please include photographs of the packaging, shipping labels and damagedgoods.

Once we receive your request, we will review the information provided and contact you as soon aspossible. If necessary, we may ask for additional information, photographs or documents.

Updates regarding the progress of your case will be sent to the email address provided in yourrequest.

Spare parts

We offer a wide range of original spare parts for BORNIAK products. Spare parts may also beavailable after the warranty period has expired.
